South Beach Clubwear.com VIP REWARDS PROGRAM
Exclusively for South Beach Clubwear.com’s registered customers, every time you shop at South Beach Clubwear’s online store at www.southbeachclubwear.com you can earn points. You earn a point for every dollar you spend it is that simple.
VIP MEMBERSHIP/ENROLLMENT
You become enrolled in the South Beach Clubwear rewards program by simply making a purchase and providing us with a verified Email address. It is that simple. There are no fees or charges to become a member of the South Beach Clubwear VIP program. Only individuals are eligible for membership (i.e., corporations, affiliates or other entities are not eligible). Only one account per person is allowed and different accounts cannot be combined. Employees of South Beach Clubwear, Inc. are not eligible for membership.
POINTS
Points begin to accrue as soon as you start purchasing. No points will be earned for any purchases made prior to the start of our VIP program which began 11-30-2007. One reward point is issued for every net dollar spent at South Beach Clubwear.com regardless of your method of payment. All dollar amounts are rounded down. Your points translate into dollars by 2%, meaning that each point equals $0.2. Points are earned on net dollars (i.e., no VIP reward points are earned on any fees, discounted dollar amounts, applicable taxes, shipping and handling charges, returns, credits, purchases of gift cards and/or gift certificates, or value of Reward Discount Coupon amount used). Reward points are not transferable. Not valid for cash. Offer is not transferable and cannot be combined with other offers.
USE OF REWARD VIP DISCOUNT COUPON
Reward Discount Coupons are valid and redeemable online through www.southbeachclubwear.com. The value of the Reward Discount Coupon will be applied against the pre-tax purchase amount (i.e., excluding taxes, fees, shipping and handling charges). Customer will be responsible for paying all taxes, fees and shipping and handling charges. Customer must purchase through there registered account for redemption. VIP Reward Discount Coupons may not be used to purchase gift cards or gift certificates or be applied towards any shipping or handling charges or other fees. VIP Reward Discount Coupons are not redeemable for cash or cash equivalent and may not be applied toward payment of any outstanding account balances, or previous purchases. VIP Reward Discount Coupon(s) are not transferable and may not be combined (excluding sales) with other South Beach Clubwear.com promotions or other discounts. Once a VIP Reward Discount Coupon has been redeemed, it will not be refundable and no credits will be issued for any reason. South Beach Clubwear.com is not responsible for lost or stolen VIP Reward Discount Coupons.
EXPIRATION
Your VIP Reward Points must be used within the year they are earned or they will expire Jan1st of that next year.
RETURNS AND EXCHANGES FOR PURCHASES MADE WITH REWARD DISCOUNT COUPONS.
Returns and exchanges will be processed in accordance with South Beach Clubwear’s return and exchange policy. The customer will receive a refund for the total amount of the returned item less any Reward Discount Coupon(s) amount(s) redeemed (applied proportionately to the total purchase amount based on the number of items purchased); No credit and/or refund Reward Discount Coupon will be issued. South Beach Clubwear VIP reward point balance will be debited to reflect any returns or credits.
CHECKING YOUR POINTS
You can check your points earned through logging into your account online at www.southbeachclubwear.com. A valid Email address is required to check point’s online. South Beach Clubwear.com will attempt to credit accounts with points on a timely basis. Points may take up to 24 hours to be updated to your account after your item has been shipped. Any claim for points not credited accurately must be received by South Beach Clubwear.com within 45 days from the date of claimed accrual of such points. South Beach Clubwear.com shall have no liability for any failure, delay or error in crediting points to your account, or any error regarding out VIP point system.
INACTIVITY/CANCELLATION
In the event, a VIP membership account is not utilized for a full calendar year; South Beach Clubwear.com reserves the right to cancel your membership and zero out the points earned. You may re-enroll in the program, however, previously earned points that were zeroed out will not be credited and you will start with a balance of zero points.

IN NO EVENT SHALL South Beach Clubwear, Inc. BE LIABLE FOR ANY LOSS, CLAIM, DAMAGE, OR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION LOST PROFITS) ARISING OUT OF OR RELATED TO THE ENROLLMENT, MEMBERSHIP OR USE OF THE South Beach Clubwear VIP REWARDS PROGRAM (WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHER FORM OF ACTION) OR ITS TERMINATION, AND IRRESPECTIVE OF WHETHER South Beach Clubwear, Inc. HAS BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH LOSS OR DAMAGE. DISCLAIMER OF WARRANTY: MEMBERS EXPRESSLY AGREE THAT PARTICIPATION IN THE South Beach Clubwear.com VIP REWARDS PROGRAM IS AT HIS OR HER SOLE RISK. THE PROGRAM IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
